Marital Issues - Frequently Asked Questions

The goal of Divorce, Dissolution and Legal Separation is to divide marital assets and debts and to put together a plan for parenting minor children.  

What are some highlights of the differences?

     Divorce:

1.       Either party can initiate the divorce process.

2.       Do not need a full and complete agreement prior to filing.

3.       Do not need the cooperation of both parties.

4.       Will likely be finalized in one (1) year or less.

5.       May have temporary orders regarding custody, parenting time, child support, spousal support, etc. during the pendency of the process.

 

      Dissolution:

1.       Need a full and complete agreement between the parties before filing with the court.

2.       No temporary orders during the pendency of the process.

3.       Typically only requires one short hearing.

 

         Legal Separation:

1.       Not as common in Ohio.

2.       The process is very similar to a Divorce or Dissolution.  The parties are not divorced though and may not remarry. There are very narrow reasons that a Legal Separation may be appropriate.
