Safe Keeping of Last Will & Testament

Clients often ask about the safe keeping of their original Last Will and Testament as it is a major concern that their Executor be able to readily access it at the appropriate time.  Our office can advise you as to storage options to make sure your Will is not lost, damaged, destroyed and/or delay the probate process.

            For example, many people choose to place their Will within their own safe deposit box and although an Executor is named in a Will they do not actually have the authority to act as the Executor until appointed by the Court.  Therefore, access to a safe deposit box may be denied until authority is given by the Court to enter such.  This could delay matters until the original Will can be obtained and admitted to Court.
